SHIPPING POLICY

This Shipping Policy explains order processing, shipping, customer-carrier accounts, freight, customer-arranged pickups, and international shipments for purchases from Energy Safety Supply (“ESS,” “we,” “us,” or “our”). It forms part of our Terms of Service and Conditions of Sale.

1. Processing time and transit time

Processing time is the time required to confirm, prepare, pack, and release an order for shipment. Transit time is the time the carrier requires to transport the shipment after pickup. They are separate time periods.

Most in-stock products generally ship within 1–7 business days after ESS accepts the order, payment or approved credit is confirmed, and we receive all information needed to fulfill the order. Business days are Monday through Friday, excluding applicable holidays.

The 1–7-business-day timeframe is a processing estimate, not a delivery guarantee. Carrier transit time begins after the shipment leaves the warehouse. Product-specific lead times shown on a product page, quote, order acknowledgment, or written communication replace the general estimate.

If you have a required delivery date, contact ESS before ordering or selecting expedited shipping. An expedited carrier service shortens transit time only; it does not automatically shorten warehouse processing, manufacturing, customization, or supplier lead time. A delivery date is guaranteed only when an authorized ESS representative expressly confirms it in writing.

2. Custom, configured, and made-to-order products

Custom products, configured products, special-order items, and stocked or configured FME cabinets require additional time. Cabinets and similar built-to-order products generally require approximately 3–8 weeks to build, unless the applicable quote or order acknowledgment states a different lead time.

The estimated build period begins only after ESS has received:

The customer’s final product selection and configuration;

Any required dimensions, specifications, logo files, drawings, approvals, or other order information;

The required payment, deposit, or approved purchase order; and

Any manufacturer acknowledgment required for the order.

Changes requested after approval may restart or extend the lead time and may change the price or freight requirements. Manufacturing and build times are estimates unless ESS expressly guarantees a completion date in a signed writing.

3. Shipping options

Depending on the product, destination, and order, one or more of the following options may be available:

A. Shipping arranged by ESS

ESS can arrange UPS, FedEx, LTL freight, or another appropriate carrier service. The available rate may be displayed at checkout, provided in a quote, or confirmed after the packed dimensions and weight are known.

For oversized, palletized, high-value, custom, or freight-class items, the checkout amount may not represent the final available freight service. If additional approval is required, ESS will contact the customer before shipment. We will not add a material freight charge without customer approval.

B. Shipping billed to the customer’s UPS or FedEx account

Approved customers may ask ESS to ship using the customer’s valid UPS or FedEx account. If this option displays $0 at checkout, it does not mean free shipping. It means ESS is not collecting the carrier charge during checkout because UPS or FedEx will bill the freight charge directly to the customer’s carrier account.

Customers selecting this option must provide:

The carrier name;

A valid carrier account number;

The billing postal code and any third-party billing information required by the carrier;

The requested service level; and

Any authorization the carrier requires for third-party billing.

ESS will contact the customer using the checkout contact information to obtain or confirm these details. Do not place a carrier account number in a publicly visible message, product review, or other public field. The order will be held until the carrier account information is received and successfully validated.

The customer is responsible for charges billed by the carrier, including transportation, fuel, residential or commercial adjustments, address corrections, dimensional-weight adjustments, duties, taxes, brokerage, and other carrier fees. If the carrier rejects the account number or third-party billing request, ESS will contact the customer for corrected information or an alternative approved shipping method before releasing the order.

Customer-account shipping may not be available for every product, carrier, destination, hazardous or restricted item, oversized shipment, or manufacturer-direct shipment. ESS will offer an alternative when the selected method cannot be used.

C. Customer-arranged carrier pickup

International and domestic customers may arrange pickup by their own carrier or freight forwarder when ESS approves that method. Customer-arranged pickup is by appointment only from the warehouse location confirmed by ESS, which is commonly our Texas fulfillment warehouse.

Do not dispatch a carrier until ESS sends a written Ready for Pickup notice. A production estimate, order acknowledgment, or expected completion date is not a pickup authorization.

Before pickup, the customer or its forwarder must provide all required carrier instructions, labels, bill of lading, account or billing authorization, pickup reference, contact information, and any export or customs documents for which the customer is responsible. ESS will provide the final pickup location, available pickup window, package or pallet count, and available dimensions and weights after the shipment is prepared.

The customer is responsible for carrier booking, transportation charges, freight-forwarder fees, export or import arrangements, and destination charges unless an accepted ESS quote expressly states otherwise.

4. Freight and oversized products

Cabinets, large equipment, palletized orders, and other oversized products may require LTL or dedicated freight service. Freight delivery may require a loading dock, forklift, liftgate, delivery appointment, or other site-specific service.

The customer must tell ESS before shipment whether the destination is commercial or residential and whether it requires a liftgate, limited-access service, inside delivery, appointment, notification, or other special handling. Charges caused by incomplete or inaccurate delivery information may be billed to the customer when permitted by law.

Freight customers should inspect the shipment before signing the delivery receipt when reasonably possible. Note visible damage or missing pieces on the carrier’s delivery record, take photographs, and retain all packaging and documents.

5. Shipping addresses and delivery changes

Customers are responsible for providing a complete and accurate shipping address, recipient name, telephone number, email address, site-access information, and any required purchase-order or delivery references.

Contact ESS immediately if an address needs to be changed. We cannot guarantee a change after fulfillment or carrier pickup begins. Carrier address-correction, reconsignment, redelivery, storage, or return charges caused by customer-provided information may be charged to the customer when permitted by law.

Some services cannot deliver to a PO box, military address, residential address, remote area, secured industrial site, or other restricted location. ESS may contact the customer to select an appropriate alternative.

6. Shipping charges

Shipping charges may be:

Collected by ESS at checkout;

Added to an approved quote or invoice;

Confirmed after final shipment dimensions and weight are available;

Billed directly to the customer’s approved UPS or FedEx account; or

Paid directly by the customer to its carrier or freight forwarder.

A shipping method showing $0 because the customer elected carrier-account billing or customer-arranged pickup is not a free-shipping offer. ESS offers free shipping only when a product page, promotion, quote, or checkout option expressly uses the words “Free Shipping.”

7. Tracking and shipment notices

When tracking is available, ESS will send it to the email address or telephone number supplied with the order. Tracking may take time to update after the carrier receives the shipment.

For freight or customer-arranged pickup, shipment documents or tracking may come from the carrier, freight forwarder, manufacturer, or ESS, depending on the arrangement.

8. Backorders, partial shipments, and delays

If an item is backordered or a material delay becomes known, ESS will contact the customer with the available information and options. Depending on the order, the customer may choose to wait, approve a substitute, accept a partial shipment, or cancel the affected unshipped item when cancellation is available.

ESS will not knowingly substitute a different product, manufacturer, material, capacity, standard, package quantity, or configuration without customer approval.

ESS may make a reasonable partial shipment unless the accepted order states that partial shipments are not permitted. Additional freight caused solely by an ESS-elected partial shipment will not be charged without customer approval.

If ESS cannot ship within a promised timeframe, we will provide any revised shipping information, cancellation opportunity, and refund required by applicable law. An approved refund for a canceled, unshipped order will be returned to the original payment method unless the customer affirmatively chooses store credit.

9. Lost, damaged, short, or incorrect shipments

Inspect the shipment promptly after delivery. Notify ESS as soon as reasonably possible—preferably within five business days—if:

A package appears lost;

The shipment arrives damaged;

Products or packages are missing;

The wrong product or quantity was delivered; or

Tracking shows delivery but the shipment cannot be located.

Preserve the product, carton, pallet, labels, packing materials, delivery receipt, bill of lading, and photographs. These materials may be required for a carrier or manufacturer claim. Do not install, alter, place into service, or return a reportedly wrong or damaged product until ESS provides instructions, unless immediate action is reasonably necessary to prevent injury or further damage.

ESS will reasonably assist with a timely carrier claim. Reporting within the preferred five-business-day period helps preserve claim rights, but it does not waive a right that cannot lawfully be waived or prevent a claim involving a latent defect.

10. International orders

ESS supports international orders. Many international customers choose customer-arranged pickup from the Texas warehouse using their own carrier or freight forwarder. ESS may also quote international shipping when requested and available.

Unless an accepted ESS quote expressly states otherwise, the customer is the importer of record and is responsible for:

Import eligibility and destination-country product requirements;

Customs entry, broker selection, permits, licenses, and end-use documentation;

Duties, tariffs, value-added tax, goods and services tax, brokerage, storage, demurrage, and destination fees; and

Compliance with applicable export controls, sanctions, and import laws.

International delivery estimates can be affected by customs clearance, inspections, carrier routing, documentation, weather, and other events outside ESS’s reasonable control. ESS will not declare a false value, misdescribe goods, or identify a commercial shipment as a gift.

11. Events outside reasonable control

ESS is not responsible for delay caused by events outside its reasonable control, including severe weather, natural disaster, fire, epidemic, war, civil disorder, government action, embargo, labor disruption, carrier interruption, customs delay, cyberattack, utility outage, raw-material shortage, or manufacturer delay.

ESS will use commercially reasonable efforts to communicate a material delay and resume performance. This section does not remove a cancellation or refund right required by law.

12. Title and risk of loss

Title and risk of loss are governed by the Terms of Service and Conditions of Sale and any delivery term stated in an accepted ESS quote or order acknowledgment. Unless an accepted ESS quote states otherwise, title transfers after full payment and risk of loss transfers when conforming goods are duly released to the carrier. Risk of loss for materially nonconforming goods remains with ESS to the extent required by applicable law.

14. Policy changes

ESS may update this Shipping Policy prospectively by posting a revised version and changing the “Last updated” date. The version in effect when ESS accepts an order governs that order unless the parties agree otherwise in writing.
